A bank levy is one of the most destructive collection tools in the IRS arsenal. Unlike a wage garnishment, which takes a percentage of future paychecks, a bank levy immediately freezes the entire available balance in your checking, savings, or business accounts up to the full amount of the tax debt.

The moment your financial institution receives Form 668-A(ICS) (Notice of Levy), the IRS locks your funds. However, the bank does not send your money to the IRS immediately. The bank must hold the frozen funds for 21 calendar days (IRC § 6332(c)) before transmitting your funds to the U.S. Treasury. It freezes funds present in the account at the exact time the bank receives the order. That specific levy does not freeze any funds deposited after the bank processes the notice.

The 21-Day Hard Window: Days 1 through 21 represent your only window to act. An emergency release must be negotiated and formally faxed to your bank by Day 21. If not, the money is permanently transferred to the government, making recovery nearly impossible.

The 4-Step Protocol to Unfreeze Your Funds

To secure a levy release (Form 668-D) before the 21-day clock runs out, you must execute a swift, precise compliance sequence:

  1. Issue an Immediate Hold Request: Have an Enrolled Agent or Tax Attorney contact the IRS Advisory or Field Collection Unit to place a temporary administrative hold on the account.
  2. Verify Missing Tax Returns: The IRS will not issue a levy release if you have unfiled tax returns. You must prepare and file all delinquent returns.
  3. Prove Hardship or Operational Paralysis: For individuals, you must show that the frozen funds prevent you from paying basic housing, food, or medical expenses. For businesses, you must prove the levy prevents making operational payroll or vendor payments. IRC § 6343.
  4. Establish an Alternative Resolution: Transition the underlying balance into an Installment Agreement, Currently Not Collectible (CNC) status, or an Offer in Compromise.

Once the IRS approves your resolution, it faxes Form 668-D (Release of Levy/Release of Property from Levy) directly to your bank’s legal processing department, unlocking your funds.
